The Submitters allege that provisions of the “Fiscal Year 1995 Supplemental Appropriations, Disaster Assistance and Rescissions Act” (“Rescissions Act”) result in a failure to enforce effectively all applicable Federal environmental laws by eliminating private remedies for salvage timber sales. Specifically submitters allege that the rider in Rescissions Act 2001(a)(3) provides that salvage timber sales shall not be subject to administrative review and that the sales shall be deemed to satisfy all federal environmental and natural resource laws.
