You can use this form to prepare and submit a Submission on Enforcement Matters (SEM) under Article 24.27 of the new North American free trade agreement, USMCA/CUSMA, effective July 1, 2020.

The SEM process was originally created by the North American Agreement for Environmental Cooperation (NAAEC). The SEM process is now part of Chapter 24 of the USMCA/CUSMA with some minor changes.

Before you start to fill this form, please have on hand the following data:

  • A list of environmental law provisions that you allege are not being effectively enforced
  • A statement of facts describing the situation (MS Word or PDF to upload)
  • Any additional documents that support your claims (file(s) to upload)

Important: If your submission is incomplete, the Secretariat will prepare a determination according to Article 24.27(2) and (3) of the Agreement detailing the missing information. You can revise the submission and submit it again. You may use this form again to resubmit it.
