In June 1998, Sierra Legal Defence Fund, on behalf of Sierra Club of British Columbia, Environmental Mining Council of British Columbia, and Taku Wilderness Association (the “Submitters”), filed a submission with the Secretariat alleging the systemic failure of the Government of Canada to enforce s. 36(3) of the Fisheries Act (“s. 36(3)”) against mining operations in British Columbia, in particular as regards violations of s. 36(3) caused by acid rock drainage (“ARD”). S. 36(3) prohibits the deposit of deleterious substances into waters frequented by fish, unless authorized by regulation.
On 4 October 1997, The Friends of the Oldman River filed a submission (SEM-97-006 (Oldman River II), the “submission”) with the Secretariat asserting that Canada is failing to effectively enforce the fish habitat protection provisions of the federal Fisheries Act and related provisions of the Canadian Environmental Assessment Act (“CEAA”).
On 16 November 2001, the CEC Council unanimously instructed the Secretariat to develop a factual record with respect to assertions regarding logging at Sooke River and De Mamiel Creek, two sites in the Sooke watershed on Vancouver Island, British Columbia. These two areas were mentioned in submission SEM-00-004 (BC Logging), filed on 17 March 2000, by five environmental nongovernmental organizations from Canada and the United States.

On 16 November 2001, the CEC Council voted unanimously to instruct the Secretariat to develop a factual record with respect to two specific cases identified in submission SEM-99-002, filed on 19 November 1999 by several environmental nongovernmental organizations from Canada, Mexico and the United States. The first case involves the logging of several hundred trees by a private landowner during the nesting season of great blue herons, allegedly resulting in hundreds of crushed eggs.
