The following paper was originally developed as a memorandum in June 2000 for the Submissions on Enforcement Matters Unit of the CEC Secretariat. In January 2001, it was distributed to members of the Joint Public Advisory Committee (JPAC) and Alternate Representatives of the CEC Council. During preparation of the current volume in the NAELP series, it was updated to reflect developments in international law.
On 14 August 2003, Waterkeeper Alliance, Lake Ontario Waterkeeper, Société pour Vaincre la Pollution, Environmental Bureau of Investigation, and Upper St. Lawrence Riverkeeper/Save the River! filed a submission with the Secretariat pursuant to NAAEC Article 14.
On 17 June 2003, Ángel Lara García (the “Submitter”) filed a submission with the CEC Secretariat asserting that Mexico is failing to effectively enforce its environmental law in connection with a polystyrene latex manufacturing and impregnation plant operated by ALCA, S.A. de C.V. (“ALCA”).

On 6 February 2002, Canadian Nature Federation, Canadian Parks and Wilderness Society, Earthroots, Federation of Ontario Naturalists, Great Lakes United, Sierra Club (United States), Sierra Club of Canada, and Wildlands League (together, the “Submitters”), represented by Sierra Legal Defence Fund, filed with the Secretariat a submission alleging that Canada is failing to effectively enforce federal migratory bird conservation legislation in connection with logging operations in Ontario.
