Submission

Grand-Brûlé—Saint Sauveur Supply Line

Submission ID: SEM-18-005
Party concerned: Canada
Date filed: December 7, 2018
Submission Status: Closed

Latest Update: May 24, 2019

The Secretariat determined that the revised submission did not meet the Article 14(1) criteria and terminated the process under guideline 6.3.

Summary of the matter addressed in the submission:

The Citizen Advisory Committee of Saint-Adolphe-d’Howard (Comité aviseur de citoyens de Saint-Adolphe d’Howard) and a group of residents assert that the province of Quebec is failing to effectively enforce its environmental laws with respect to a power supply line project that will run through the municipality of Saint-Adolphe-d’Howard in Quebec, Canada. The project is being carried out by Hydro-Québec, which is the province’s public utility. The Submitters assert that due to the legal immunity that the law grants to Hydro-Quebec, they are unable to obtain an injunction, which they consider is a failure to effectively enforce the obligations contained in Articles 3 and 6 of the North American Agreement on Environmental Cooperation (NAAEC). The Submitters also maintain that the Quebec Ministry of the Environment is failing to enforce the Quebec Sustainable Development Law which requires that the ministry responsible for authorizing the project to consider sustainable development objectives and conduct public consultation activities. The Submitters also maintain that despite having proposed an alternative to the project, these were arbitrarily dismissed by the Quebec government.

Names and citations of the environmental laws in question:

North American Agreement on Environmental Cooperation; Quebec Sustainable Development Law (LRQ c. D-8.1.1).

Submitter(s):

The Citizen Advisory Committee of Saint-Adolphe-d’Howard, Sarah Perreault, Denise Payette, Lisette Lapointe, Guy St-Jacques, Martial Fortin, Georges Jardon, Nicole Chouinard, Pierre Dubé, and Alain Thiffault
